Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") govern your access to and use of AutoVision AI (the "Service"), operated by Maxim Vogt ("we", "us", "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. You represent that you are of legal age to form a binding contract and, if using the Service on behalf of an organisation, that you have authority to bind that organisation.

2. Description of service

AutoVision AI is an AI-powered vehicle condition analysis and deal-finding platform. The Service provides automated visual analysis of vehicle images, damage detection, market comparison, and dealer deal aggregation. We do not guarantee that the Service will be uninterrupted, error-free, or that analysis results are 100% accurate. Outputs are provided for informational purposes and should not replace professional vehicle inspection or financial advice.

3. Account and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep it updated. You must not share your account or allow others to access it. Notify us immediately of any unauthorised use.

4. Acceptable use

You agree not to misuse the Service, including but not limited to:

• Using the Service for any unlawful purpose or in violation of applicable laws.
• Uploading or generating fraudulent, misleading, or illegal content.
• Attempting to interfere with, disrupt, or gain unauthorised access to the Service or its infrastructure.
• Using automated means (bots, scrapers) to access the Service without our written consent.
• Reverse engineering, decompiling, or attempting to extract the source code of the Service.
• Circumventing any technical limits, access controls, or subscription checks.
• Reselling, redistributing, or sublicensing access to the Service.

5. Intellectual property

All content, software, designs, logos, and branding associated with AutoVision AI are owned by Maxim Vogt or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose within your selected plan. You retain ownership of any content you upload, but grant us a limited licence to process it solely to provide the Service.

6. Payment, subscriptions, and Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscription fees, billing cycles, taxes, and payment terms are managed through Paddle. By subscribing, you authorise Paddle to charge your payment method on a recurring basis until cancelled. 7. Subscription cancellation

You may cancel your subscription at any time through your Paddle account or by contacting us. Upon cancellation, your access to paid features will be revoked immediately. No refunds are provided for partial subscription periods unless required by law or covered under our refund policy. We reserve the right to cancel your subscription and terminate access if you breach these Terms.

8. Warranties and disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANALYSIS RESULTS ARE ACCURATE OR COMPLETE. VEHICLE ANALYSIS OUTPUTS ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL ADVICE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAXIM VOGT'S AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR FRAUD, DEATH, OR PERSONAL INJURY WHERE REQUIRED BY LAW.

10. Indemnity

You agree to indemnify and hold harmless Maxim Vogt from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, repeated or serious policy violations, or as required by law. Upon termination, all licences granted to you cease, and you must cease all use of the Service. Provisions that by their nature should survive termination will remain in effect.

12. AI-generated content

AutoVision AI uses generative AI and computer vision models to analyse vehicle images and provide assessments. You are responsible for the images you upload and how you use the outputs. You must have rights to any content you upload. You must not use the Service to generate or analyse illegal content, deepfakes, hate speech, or malware. AI outputs may be inaccurate or incomplete and are not suitable for regulated professional advice without independent verification.

13. Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.

14. Changes to these Terms

We may modify these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
